HYBE EXPERIENCE

Welcome to our Terms and Conditions for participation in public events organized by Hybe Latin America, S.A. de C.V. (“HYBE”), with its registered office located at Prado Norte 225, Lomas de Virreyes III Section, Miguel Hidalgo Borough, Zip Code 11000, Mexico City. We appreciate your interest and attendance at events held by HYBE and/or its affiliates or authorized third parties. These Terms and Conditions govern your participation and attendance at the event titled “HYBE Experience” (the “Event”), and outline the commitments you (hereinafter referred to in singular or plural as “Attendee(s)” or “Participant(s)”) voluntarily make to HYBE and/or its affiliates or authorized third parties. By attending the Event and/or participating in the activities taking place at the Event, the Attendee and/or Participant accepts all of the terms and conditions set forth herein, provides their express consent to the processing of their personal data, authorizes the use of their image, and expressly agrees to the transfer of rights as stated in this document.

This document is intended to establish the applicable rules for attending and participating in the Event, specifically in the “HYBE Experience.” Your attendance and/or participation in the Event constitutes your acceptance of all rules and conditions.

CONTENTS

  1. Registration and Account Security: The Attendee and/or Participant acknowledges that, as a prerequisite for attending and participating in the Event, they must complete registration via one of the following websites: https://experienciahybe.com/ or https://campaigns.weverse.io/WV71LPB27 (together referred to as the “Site”). All information collected through the Site will be handled in accordance with HYBE's privacy notice, which can be reviewed at the following link: https://sites.google.com/hybecorp.com/sitio/home

    By using the Site, you agree to: (a) provide accurate, current, and complete information about yourself as requested in any registration form on the Site (“Registration Information”); and (b) maintain the security of your password and identification. The Attendee and/or Participant is solely responsible for maintaining the confidentiality of their account login credentials, including username, password, or any other authentication data. Use of the account is strictly personal and non-transferable, and sharing of login credentials with third parties is expressly prohibited.

    Any activity conducted from the attendee's account will be presumed to have been performed by the account holder; therefore, the Event organizer shall not be held liable for unauthorized use of the account in the event the attendee fails to adequately protect their login credentials.

    If you detect unauthorized access or misuse of your account, you must notify the Event organizer immediately through the designated contact method. The organizer reserves the right to suspend or permanently cancel the attendee's access if any misuse or violation of these terms is detected.

    Any activity carried out using the attendee's account will be presumed to have been performed by the attendee. Therefore, the Event organizer shall not be held responsible for any unauthorized use of the account in cases where the attendee failed to properly safeguard their login credentials.

    In the event of unauthorized access or misuse of the account, the Attendee and/or Participant must immediately notify the Event organizer through the designated contact method. The organizer reserves the right to suspend or permanently cancel the attendee's access if any misuse or violation of these terms and conditions is detected.

  2. The Event: The Attendee and/or Participant acknowledges and accepts that the recreational activities conducted during the Event may include, but are not limited to: interactive, educational, and physical activities such as dancing, light shows, laser displays, sound effects, etc. The attendee confirms they are aware of the nature of these activities and declares that they do not have any medical condition, injury, or have consumed any substance, medication, drug, or alcohol that could negatively impact their physical and/or mental well-being or affect their ability to enjoy the Event.

    The Attendee and/or Participant also understands that the Event constitutes a temporary cultural experience with free public access, located at Avenida 5 de Mayo 290, San Lorenzo Tlaltenango, Miguel Hidalgo, 11210, Mexico City, and will be open from July 17, 2025, to October 31, 2025, Tuesday through Sunday, from 10:00 AM to 5:00 PM, with the last admission at 4:10 PM.

    The Attendee and/or Participant expressly acknowledges that access to the Event is only available through prior registration as outlined in Section 1. By completing the registration process, the Attendee and/or Participant may receive up to four (4) access codes to the Event. These codes are personal, non-transferable, and no exchanges or modifications of any kind will be permitted.

    If the Attendee and/or Participant fails to show up on the date and time specified during registration, their access code will be considered forfeited, without any liability on the part of HYBE, its affiliates, or authorized third parties. HYBE and its partners will not be obligated to reschedule access for any other date or time

    Warning Regarding Strobe Lights and Visual Effects:

    Please note that the Event may include strobe lighting, flashing lights, or other visual effects that could trigger seizures or present risks to individuals with photosensitive epilepsy or light sensitivity. Attendees with such conditions are strongly encouraged to take the necessary precautions or refrain from attending. By attending the Event, you acknowledge and accept this risk.

  3. Eligibility and Participation in the Event: HYBE maintains a strict non-discrimination policy across all of its processes and activities. However, for the safety of all Attendees and/or Participants, HYBE reserves the right to deny admission to the Event. The sole criterion for restricting attendance will be participant safety. Accordingly, HYBE reserves the right to deny entry to children under six (6) years of age.

    In light of the foregoing, the eligibility of Attendees and/or Participants at events organized by HYBE shall be determined without discrimination of any kind and without regard to religion, gender, sexual orientation, skin color, or ethnic origin.

    However, by attending and participating in the activities of the Event, the Attendee and/or Participant acknowledges that unless specifically restricted from participating in the activities or entering the HYBE Experience, they are required to follow the instructions provided by the Event staff at all times, conduct themselves respectfully, and comply with the rules established by HYBE, its affiliates, and/or authorized third parties.

    As an Attendee and/or Participant, you must observe the following guidelines at all times, including but not limited to:(i)Do not bring to the Event or its surrounding areas any items that could be used to harm others;(ii)Maintain appropriate conduct at all times, both inside and near the Event; (iii) Treat other Attendees and/or Participants with respect at all times; (iv) Follow all instructions provided by Event staff; (v) Comply with the Event regulations, which are available on the Website and in physical form at the Event venue.

  4. Code of Conduct: The Attendee and/or Participant agrees to behave respectfully, orderly, and appropriately throughout the Event, and to follow all instructions issued by authorized personnel, including but not limited to operational staff, security personnel, and representatives of HYBE, its affiliates, and/or authorized third parties. All decisions and instructions given by HYBE personnel are final, non-negotiable, and must be complied with fully.

    The following actions are strictly prohibited: (i) Any behavior that threatens the physical or emotional integrity of other Attendees and/or Participants, Event staff, or third parties, including but not limited to aggressive, discriminatory, harassing, or disorderly conduct; (ii) Committing or attempting to commit any unlawful or criminal act, including possession or use of prohibited substances, theft, fraud, property damage, or disturbing the public order; (iii) Entering the Event with weapons, sharp objects, or under the influence of alcohol and/or controlled substances; (iv) Smoking within the Event premises or possessing prohibited substances

    Any violation of this Code of Conduct shall entitle HYBE, its affiliates, and/or authorized third parties to immediately remove the offending Attendee and/or Participant from the premises, restrict their current or future access to other events, cancel any registration benefits or credentials, and, where appropriate, file a report with the relevant authorities, without prejudice to any additional legal action.

    HYBE reserves the right to remove Attendees and/or Participants from its events for reasons including, but not limited to: inappropriate behavior, engaging in criminal conduct, or putting other Attendees and/or Participants at risk.

  5. Image Rights: By attending the Event and/or participating in activities organized by HYBE, the Attendee and/or Participant grants their express consent and assigns to HYBE, its affiliates, group companies, and/or authorized third parties the unrestricted worldwide rights to use, exploit, reproduce, transmit, distribute, publicly communicate, fix, synchronize, exhibit, and transform their image, voice, name, and any performances or appearances captured during the Event, in any format, whether audiovisual, sound, photographic, graphic, digital, or otherwise, and through any medium, whether known or hereafter developed, for the maximum term permitted by law.

    This assignment includes the right, but not the obligation, to use all or part of the resulting material through any communication medium currently existing or developed in the future, including but not limited to social media, digital platforms, websites, print media, broadcast or cable television, streaming platforms, radio, and advertising, for promotional, informational, editorial, commercial, and/or archival purposes.

    Accordingly, and in accordance with applicable regulations, by participating in or attending HYBE-organized Events, the Attendee and/or Participant voluntarily grants the broadest assignment of rights allowed under law concerning their image, voice, and any audiovisual material recorded during the Event and/or activities organized by HYBE.

    By attending and/or participating in the Event and activities organized by HYBE, and pursuant to Article 87 of the Federal Copyright Law (“Ley de Derechos de Autor”), the Participant and/or Attendee authorizes HYBE, its subsidiaries, or affiliates to use their name and image in any media and/or format for purposes of direct or indirect profit, in accordance with Article 11 of the Regulations of the Federal Copyright Law, provided such use is related to the promotion, sale, distribution, or commercialization in any form of products associated with the Event organized by HYBE, its affiliates, and/or authorized third parties.

    Consequently, the Attendee and/or Participant expressly waives any claims related to the use of their image or voice. By attending and/or participating in the Event organized by HYBE, the Attendee and/or Participant grants HYBE a free, worldwide, irrevocable, and permanent license to use their image and voice, either separately or through audiovisual content

  6. Intellectual Property: The Attendee and/or Participant acknowledges that all rights over the content generated during the Event are the exclusive property of HYBE. Attendance and/or participation in the Event shall not be interpreted as a transfer, license, authorization, or grant of any intellectual property right from HYBE to the Attendee and/or Participant.

  7. Waiver and Limitation of Liability: The Attendee and/or Participant acknowledges and accepts that the Event may be modified, rescheduled, suspended, or canceled—either in whole or in part—at any time without prior notice, and without any liability on the part of HYBE, its affiliates, subsidiaries, controlling entities, commercial partners, representatives, service providers, or any other authorized third parties, due to force majeure, unforeseen circumstances, governmental orders, or logistical, technical, or safety-related reasons.

    By completing registration to attend the Event, the Attendee and/or Participant expressly and irrevocably waives the right to pursue any civil, criminal, administrative, or other legal action against the parties mentioned above, including claims for damages, incurred costs, or any unfulfilled expectations resulting from the modification or cancellation of the Event.

  8. Personal Belongings and Valuables: HYBE will implement reasonable security measures during the Event; however, it shall not be responsible for the loss, theft, or damage of any personal items, including those stored in lockers, restrooms, studios, or any other area of the venue. Attendees are advised not to lose sight of or store valuable items in lockers.

  9. Minors: To use the Site and access the Event, minors under the age of 15 must be accompanied by an adult or must have prior consent from their parent(s) or legal guardian(s), who will be held responsible for all actions taken by the minor in their care.

    Minors aged 16 or 17 may attend the Event only if their parent(s) or legal guardian(s) expressly agree, at the time of registration, to the following:

    1. They give express consent for the minor to attend the Event and accept all terms and conditions, including this document.

    2. They release HYBE, its affiliates, staff, organizers, vendors, business partners, and/or authorized third parties from any liability for damage, incident, injury, or harm suffered by the minor during the Event, except in cases of gross negligence or willful misconduct directly attributable to HYBE.

    3. Use of image: The parent(s) or legal guardian(s) expressly authorize HYBE to use the minor’s image, voice, name, performances, or appearances under the same terms outlined in this document.

    4. Restrictions: HYBE reserves the right to deny access or remove from the Event any minor whose behavior, attire, or physical or emotional condition poses a risk to their own safety or that of others

  10. Miscellaneous: The Attendee and/or Participant acknowledges that: (i) The estimated value of access is $450.00 MXN (four hundred fifty pesos 00/100). This valuation is established to demonstrate HYBE’s good faith and constitutes fair and sufficient compensation for the authorization of image use and assignment of rights granted herein; (ii) Registration on the Site and attendance at the Event are carried out freely and voluntarily.

    Due to the nature of the Event, attendance is not recommended for pregnant individuals.

  11. Governing Law: These terms and conditions shall be governed by and interpreted under the laws of Mexico City. The Attendee and/or Participant expressly waives any jurisdiction that may apply by reason of domicile, subject matter, or any other grounds, present or future.
